“The [Texas] Court of Criminal Appeals, long criticized by defense lawyers as being pro-prosecution, voted 5 to 3 to uphold the conviction in 1998 despite DNA tests showing Criner was not the source of semen in the victim. Writing for the majority, Judge Sharon Keller said it was possible the girl had earlier engaged in consensual sex with someone other than Criner and that Criner, while raping her, had used a condom. The ruling is infamous among defense lawyers here, who ridicule it as "the unindicted co-ejaculator theory."
